$531,001.00 Jury Verdict in favor of Plaintiff in Defamation Suit

Brown v. Faseler:  Robin Brown, LPC brought a libel suit against Terry Faseler for falsely posting on FaceBook and on CitySearch.com that Brown’s license to practice in Texas as an LPC was revoked. Brown had never had any discipline, ever, however, and the words were false. In a two-day, three witness trial to a jury, the jury found that Faseler had libeled Brown and awarded $535,001.00 to compensate Brown for injury to reputation, past lost earning capacity, future lost earning capacity, and mental anguish, past and future. The award is reported by “TopVerdict” to be the third-highest defamation award by a jury in Texas for 2017.

Our client purchased a home in 2006 which the Sellers claimed in the condition disclosure had not been remediated for any contamination such as amold, and had never had any prior roof leaks, water penetration, or wood rot.  After closing, our client learned that the Seller was paid almost $40,000.00 by an insurer for repairs, including mold remediation, to chronic leaks in the roof and walls that caused etensive wood rot.  We filed suit and prepared the client's case for trial.

$5.5 Million Settlement Class Action DTPA & Contract 2010

Carl J. Kolb was the lead plaintiff's counsel, assisted by William H. Ford and Lori Massey. The client class received, after payment of attorneys' fees, approximately $3.9 Million.  These class members' recoveries represented their actual loss, plus interest, even after attorneys' fees were paid.

​$10.8 Million Verdict--DTPA, Contract, & Fraud- 2010

On October 22, 2005, Hector Viesca was killed on the job while working for Business Staffing, Inc. ("BSI"), a staff leasing company,  and Wiley, an oilfield operator.  Viesca's wrongful death beneficiaries filed suit against BSI and Wiley for wrongful death.  It was determined, to Wiley's surprise, that Wiley was not covered by a statutory workers' compensation policy as was required in the staff leasing agreement between Wiley and BSI.  Wiley settled with Viesca for $100,000.00 plus an assignment of 2/3 of any money recovered by Wiley against BSI.  Wiley and Viesca then became co-plaintiffs against BSI.  Carl J. Kolb was brought into the case to represent Wiley, and presented most of the evidence that proved both Wiley's and Viesca's case against BSI.

$250,000 Settlement Legal Malpractice – 2007

$2.2 Million Settlement Legal Malpractice - 2007

This case alleged that a major San Antonio law firm had concealed the conflict of interest from the Plaintiff, and estate.  The decedent had sold a parcel of land to a municipality for a municipal water supply some 26 years before the suit was filed, and had since died.  It was discovered after the decedent's death that the municipality had not actually paid the purchase price for the land, and had been using the land to supply the city with water for 25-plus years...
